Molino Villas has been trading from its Moraira office since 1999. We are staffed by a small friendly team with over 60 years experience of the property market in Spain and many more years living on the Costa Blanca. Land Grab Laws In Spain - How to Protect Your Purchase
Molino Villas Costa Blanca SL can now offer title deed insurance which will cover against any problems that may arise from both the Land Grab Law and any other issue that may arise in the future related to the legality and documentation for your property. That said, we believe that with the right legal advice and a good solicitor working for you, it should never be an issue for you to consider.
Majority of the properties we have are located on urbanised land, therefore the Land Grab Law does not apply. Where a property is in an area which could become subject to this Law, we would advise you accordingly. We can recommend suitable Spanish solicitors or you can choose your own. We will always work in conjunction with them to provide a stress free service.
Over recent years there has been a lot of negative publicity in the British press with regard to Land Grab in the Valencian region. Whilst this publicity has highlighted an issue that needs to be addressed, the majority of coverage has not been particularly helpful or informative. The LRAU Law was brought in during 1994 with the intention of facilitating property development and providing, at the time, much needed additional housing at a reasonable price. Over the years this Law has been abused by some developers, which has caused the problems.
One of the main issues of this Law related to land classification. There are 3 types of classification in Spain. Already urbanised land, land suitable for urbanisation and rural land. As in any country, including the UK, when a particular area grows the rural land can be reclassified by the authorities for development. When the law was introduced in Spain, it included clauses to prevent individual owners of rural properties standing in the way of development that would benefit the local area and improve services. It was also felt that they should contribute with cash or a small part of their land, towards the additional benefits they would receive i.e. mains water, electricity, new roads, sewerage etc, even though they may not particularly want these services.
Each Region has some responsibility for drawing up its own laws and in the Valencian region the LRAU was badly drafted. This allowed a small number of developers and local authorities to use a loophole against the interests of property owners.
The LRAU was replaced by the LUV, which was a modified version and has attempted to close the loopholes. The European Union has since said that this replacement law should be abolished and is currently in the process of talking to the Spanish government to achieve this.
When you are looking to purchase any property, our advice would always be to ask questions of the agent when you view a property that you might consider purchasing and always take good legal advice. If you are still not too sure, ask us about Title Deed Insurance. For a single premium you could be covered for however long you own your property.
